As such, John Bean Technologies and its affiliates (“JBT”) have created this Privacy Policy in compliance with applicable law and in order to demonstrate our firm commitment to privacy. This Privacy Policy describes the information JBT collects from and about you and our information sharing practices, including, but not limited to, the content, services, applications and related activities conducted through www.jbtc.com and the following related websites (collectively referred to as “Site”):

When we refer to “we,” “us,” or “our,” we mean JBT or the specific division, subsidiary, or affiliate that operates a Site, provides its content, or processes information received through it, each as appropriate and applicable.  When we refer to “you” or “your,” we mean the person accessing this Site.  If the person accessing this Site does so on behalf of, or for the purposes of, another person, including a business or other organization, “you” or “your” also means that other person, including a business organization.  This Privacy Policy does not apply to employees or job applicants. 


COLLECTION AND USE OF INFORMATION:

We collect the following categories and types of personal information:

  • Contact Information: your first and last name, age, street address, email address, phone number, demographic information (if you create an account with us); 
  • Other identifying information: IP address;
  • Geolocation data;
  • Internet or other electronic activity: your visits to and use of this Site, including browser type, domain names, referring website addresses, your browsing and click history, information about how you navigate within our Site and which elements of our Site you use the most, access time, length of visit and number of page views; 
  • Financial information: your billing and credit card information (if you purchase JBT’s products and services);
  • Commercial information:  products viewed on our Site; and
  • Inferences drawn from the categories described above in order to create a profile about you to reflect your preferences, characteristics, behavior and attitude.

We do not collect, use or disclose Sensitive Personal Information, as such term is defined by California law. We keep personal information as long as it is necessary or relevant for the practices described in this Privacy Policy. We also keep information as otherwise required by law.

Categories of Use 

  • Transactional Purposes: We use your contact information and commercial information to:
    • Confirm your order or your agreement to purchase goods or services from JBT;
    • Confirm and track the services that you have hired us to perform;
    • Communicate with you about any transactions carried out between you and us, including your requested services;
    • Track warranty rights and obligations;
  • Analytical Purposes: We use your geolocation data, internet activity and browsing history to analyze preferences and statistics.
  • Marketing Purposes: We use your contact information, commercial information, internet or other electronic activity, and inferences to:
    • Inform you of our new products, services and offers;
    • Provide you with other information from and about JBT including personalized marketing communications, newsletters and updates.
  • Maintenance and Improvement of Website: We use your contact information, commercial information, and internet activity and browsing history to:
    • Provide and maintain functionality on our Site;
    • Improve the Site’s usability; and
    • Help us diagnose technical and service problems and administer our Site.

Sources of Personal Information 

We collect information from the following sources: 

We collect information directly from you. We collect contact information and financial information directly from you from this Site, as well as through correspondence, faxes, e-mails, telephone inquiries, web forms and other means of communication. 

We collect information from you passively. We collect other identifying information,  geolocation information, commercial information, internet or other electronic activity passively using tools like browser cookies. This activity is further described in the Cookie Notice and Policy below. 

JBT encourages you to review the privacy statements of websites you choose to link to from JBT so that you can understand how those websites collect, use and disclose your information. JBT is not responsible for the privacy statement or other content on websites outside of the JBT website.

When We Disclose Information with Third Parties

Our Service Providers

We may contract with companies or persons to provide certain services including for back-end management of our business. We call them our Service Providers. We also use Service Providers such as Google Analytics to gather data about our Site visitors. We provide our Service Providers with the information needed for them to perform these services. We may sometimes permit our Service Providers to have access to aggregate statistics about our customers, sales, traffic patterns, usage and related information. We also ask our Service Providers to confirm that their privacy practices are consistent with ours.

Our Affiliates

We may disclose personal information with businesses controlling, controlled by, or under common control with JBT.

Cross Contextual Behavioral Advertising

We may share information with third parties in order to provide cross-contextual behavioral advertising. This may include the following categories of personal information: other identifying information, commercial information and internet and other electronic activity.

Corporate Transactions

If JBT is merged, acquired, or sold, or in the event of a transfer of some or all of our assets, we may disclose or transfer personal information in connection with such transaction. 

Law Enforcement and Courts 

JBT may disclose personal information when we have reason to believe that disclosing this information is necessary to identify, contact or bring legal action against someone who may be violating any agreement with JBT, or may be causing injury to or interference with (either intentionally or unintentionally) our rights or property, other Site users, or anyone else that could be harmed by such activities. We may disclose information in response to a subpoena, search warrant, in connection with judicial proceedings, or pursuant to court orders, legal process or other law enforcement measures. JBT may disclose or access personal information when we believe in good faith that the law requires it, to establish our legal rights or to defend against legal claims, and for administrative and other purposes that we deem necessary to maintain, service and improve our products and services.


EU DISCLOSURE

This Site is hosted in the United States and its intended use is business to business. If you are visiting this Site from outside of the United States, please note that by providing your information it is being transferred to, stored or processed in the United States and other countries, where our data center and servers are located and operated. This section sets forth the general privacy policy for the United States. Individuals located in the European Economic Area or the United Kingdom (“UK”) should see the provisions under the European/UK Privacy Policy. The Showpad privacy policy also applies when accessing JBT content via the Showpad sales enablement platform.

Public Forums

Any information you may disclose on our Site, in blogs, on message boards, in chat rooms, or on other public areas on the Site, or other third-party websites that the Site may link to, becomes public information. Please exercise caution when disclosing personal information in these public areas. We reserve the right to remove any posting or content in a posting at our sole discretion.


CALIFORNIA CUSTOMER PRIVACY RIGHTS

If you are a resident of California, Colorado, Nevada or Virginia, you have certain privacy rights under the applicable privacy laws in your state (“State Privacy Laws”). This section describes those rights and how you can exercise them with JBT.

Right to Opt out of the Sale and Sharing of Personal Information

Residents of California, Colorado and Virginia have the right to opt out of the “sale” or “sharing” of their personal data, as such terms are defined under State Privacy Laws.

Under California law, “share” means disclosing your personal information by us to a third party for cross-context behavioral advertising, in exchange for money or anything else of value. Thus, when we use the term “share” under this section, we are using it in the narrow meaning of how it is defined under California law. Other State Privacy Laws do not use the term “share,” but describe the concept as using personal information for targeted advertising.

Under the laws of California and Colorado, “sell” means exchanging your personal information by us with a third party for money or anything else of value. Under Virginia law, “sell” is the exchange of personal information for money only.

Currently, we participate in digital advertising networks to deliver advertising that is tailored to your interests. The participation in certain ad networks can constitute a “sale” or “sharing” of personal data under State Privacy Laws. The categories of third parties to whom information may be disclosed in this context is our third party partners (e.g., advertisers and marketing partners and data analytics providers). 

We may “sell” the following categories of Personal Information:

  • Online Identifiers
  • Geolocation information;
  • Internet/electronic activity;
  • Commercial information; and
  • Inferences drawn from the categories described above in order to create a profile about you to reflect your preferences, characteristics, preferences, behavior and attitudes.

You can opt-out of being tracked by these third parties by clicking HERE or the “DO NOT SELL OR SHARE MY PERSONAL INFORMATION” link at the bottom of our website.

You can also opt-out  by broadcasting an Opt-Out Preference Signal, such as the Global Privacy Control (GPC) (on the browsers and/or browser extensions that support such a signal).  Note that we will only apply the request to that specific device or browser and only for cookie or pixel based selling and sharing.  Thus, you will need to opt out on each browser and device where you use our services. If you clear your cookie history on a particular browser or device, your opt out request will no longer be saved.

Please note that, otherwise, JBT does not presently exchange Personal Information for money with anyone, nor does JBT otherwise share Personal Information within the meaning of “sale.”  Also, JBT does not currently disclose Personal Information to third parties for their direct marketing purposes.

Consumer Privacy Requests

If you are a resident of California, Colorado or Virginia, you have legal rights in addition to the choices listed above.  These rights include the following: 

  1. Access:  to learn the categories of information we collect and use, and for those in California, the categories of sources of collection and disclosure and the business purpose for collection;
  2. Portability: a copy of (Virginia) or specific pieces of (California) personal information collected;
  3. Deletion: to have us delete information we collected from you;
  4. Correction: asking us to fix your information; and
  5. Non-retaliation: not to be discriminated against for exercising one or more of these rights.

For data portability requests, we will select a format to provide your personal information that is readily usable and should allow you to transmit the information from one entity to another entity without hindrance.

We may not delete all of your personal information if one of the following exceptions applies:

  • Transactional: to complete a transaction for which the personal information was collected, provide a good or service requested by you, or perform a contract we have with you;
  • Security: to detect data security incidents;
  • Error Correction: to debug or repair any errors;
  • Legal: to protect against fraud or illegal activity or to comply with applicable law or a legal obligation, or exercise rights under the law, such as the right to free speech; or
  • Internal Use: to use your personal information, internally, in a lawful manner that is compatible with the context in which you provided the information (i.e. to improve our services).

Please note that if we delete your personal information, many of our services will not work the same. For example, your previous opt out requests will not be saved, you will not have an account, and any saved preferences and information will no longer be available.

To submit a request to access, delete, correct or portability, please send us an email at [email protected]. You must use “Consumer Privacy Request” in the subject line of your email. Alternatively, you may call use toll free at 1-866-973-0846.  In order to verify your identity, we will request you to provide contract identification number, or similar data known only to you. To designate an authorized agent to act on your behalf, you must send a signed, written authorization containing your and the authorized agent’s name, email address, phone number, and address. You must also note what requests the authorized agent is able to make (i.e. deletion requests). We cannot respond to your request, or one made on your behalf, if we cannot verify your identity or authority to make the request.  If you wish to make multiple requests under this section, we recommend sending the deletion request last, as we will not be able to fulfill your other requests once we have deleted your information. Note that we may also maintain a record of your Consumer Privacy Request.

Right to Limit Disclosure of Sensitive Personal Information

If you are a California resident, you have a right to limit the processing of your Sensitive Personal Information (as defined by California law).  We do not collect or process any Sensitive Personal Information.

Right to Appeal

If you are a Virginia or Colorado resident and we were unable to fulfill your request, you may appeal our request by emailing us at [email protected] within fourteen days of our decision, and provide a detailed reason for your appeal, as well as your state of residence. 

Notice to Nevada Residents/Your Nevada Privacy Rights With respect to Nevada SB220’s amendment of the Nevada Privacy of Information Collected on the Internet from Consumers Act, JBT. does not sell for monetary consideration the personal information of Nevada consumers for the purpose of resale to other entities.


SECURITY

We use physical, technical, and procedural security safeguards appropriate to the sensitivity of personal information to protect it from loss or theft, as well as unauthorized access, disclosure, copying, use or modification. These safeguards include physical measures, such as restricted access to offices and equipment, organizational measures, such as security clearances, and publishing this policy to appropriate personnel with instructions to act in accordance with its principles (for example, limiting access on a “need to know” basis), and technological measures, such as the use of passwords and/or encryption. However, no data transmission over the internet or other network can be guaranteed to be 100% secure.  As a result, while we strive to protect information, we cannot and do not guarantee the security of any information you transmit on or through the services, and you do so at your own risk.

Further public disclosure here of our security measures could aid those who might attempt to circumvent those security measures. To ensure that our employees comply with our privacy policies, we provide employees with the tools and knowledge to protect the personal information they may handle. Any employee who violates our privacy policies is subject to disciplinary action, including possible termination and civil and/or criminal prosecution.


RESPONSE TO “DO NOT TRACK” SIGNALS

Some Internet browsers include the ability to transmit “Do Not Track” signals. Since uniform standards for “Do Not Track” signals have not yet been adopted, JBT does not process or respond to “Do Not Track” signals and JBT may continue to collect information in the manner described in this Privacy Policy. CHILD ONLINE PRIVACY PROTECTION ACT (COPPA) COMPLIANCE AND RELATED INFORMATION

The Site is intended for users who are 18 years old or older.  The Child Online Privacy and Protection Act (COPPA) regulates online collection of information from persons under the age of 13. It is also our policy to refrain from knowingly collecting or maintaining personal information relating to any person under the age of 18. If you are under the age of 18, please do not supply any personal information through the site. If you are under the age of 18 and have already provided personal information through the site, please have your parent or guardian contact us immediately by emailing us at [email protected] so that we can remove such information from our files.

This Privacy Policy may be revised from time to time as we add new features, products and services, as laws change, and as industry privacy and security best practices evolve. Personal Information 

Personal information is generally any information about an identifiable individual. Personal information we collect from you includes your name,  mailing address, job title and company name, phone number, and e-mail address,. 

Collection of Personal Information

We collect personal information from this Site, as well as through correspondence, faxes, e-mails, telephone inquiries, web forms, and other means of communication. We collect such information when we market and provide products and services to you or for other lawful purposes. 

We (and our affiliates and authorized service providers) collect, store and use information, such as:

  1. about your visits to and use of this Site;
  2. when you order or agree to purchase or avail yourself of goods or services;
  3. to track warranty rights and obligations;
  4. to provide product information (whether with regard to service or otherwise); 
  5. about any transactions carried out between you and us;
  6. you provide to us if you correspond with us;

We use this information in the administration of this Site, to improve the Site’s usability, to provide better service, to send you newsletters, updates, marketing communications, and other information that may be of interest to you. We also use outside services such Google Analytics to gather data about our Site visitors. We sometimes permit our authorized service providers to have access to aggregate statistics about our customers, sales, traffic patterns, usage and related information.

We often collect personal information from you or from third parties and as agents on behalf of third parties, where we have obtained the requisite consent to do so or as otherwise permitted by law. Third parties include, for examples, organizations we work with to provide services to you or on your behalf, and organizations that perform outsourcing and other services for us (such as systems development and maintenance organizations).

How We Use Personal Data

As a general matter, we collect personal information primarily to provide services to our customers, for administrative or management requirements, and to enhance our relationship with customers.

JBT collects and uses your personal information to operate its Site and deliver the services you have requested.

JBT also uses your personal information to inform you of other products or services available from JBT and its affiliates. JBT may also contact you via surveys to conduct research about your opinion of current products or services or of potential new products or services that may be offered.

JBT does not sell, rent or lease its customer lists to third parties.

Statistical Data

JBT discloses data to trusted partners to help perform statistical analysis, send you an e-mail or postal mail, provide customer support, or arrange for deliveries. All such third parties are prohibited from using your personal information except to provide products or services to you, and they are required to maintain the confidentiality of your information.

JBT keeps track of the websites and pages our users visit within JBT, in order to determine what information is the most popular. This data is used to deliver customized content and advertising to customers whose behavior indicates that they are interested in a particular subject area.

Disclosures of Information

JBT will disclose your personal information, only if required to do so by law or in the good faith belief that such action is necessary to: (a) conform to the edicts of the law or comply with legal process served on JBT or the Site; (b) protect and defend the rights or property of JBT; and, (c) act under exigent circumstances to protect the personal safety of users of JBT, or the public.

We disclose your personal information with other business entities in connection with the sale, assignment, merger or other transfer of all or a portion of John Bean Technologies Corporation’s, or one of its subsidiary’s or affiliate’s, business or assets to such business entity (including due to a sale in connection with a bankruptcy). Where legally required we will give you prior notice and if you have the legal right to do so, allow you to object.

Legal Basis

Our legal basis for processing and collecting personal information varies based on the context for which it is collected. We rely on the following legal grounds to process your personal information, namely:

Performance of a contract –To enter into a contract or to perform a contract that you or your company has with us.

Consent – Where required by applicable laws, we will rely on your consent for collecting your personal information.

Legitimate interests – We may use your personal information for our legitimate interests to improve our products and services. Consistent with our legitimate interests we may use technical information as described in this Policy and use personal information for our marketing purposes.

We will only process personal information for the specific purposes communicated to you or for any other purposes specifically permitted by law.

Obtaining Consent

Except when otherwise permitted by law, we obtain the requisite consent prior to collecting and, in any case, prior to using or disclosing your personal information for any purpose not previously communicated to you. You may provide your consent to us orally, in writing, by electronic communication, or any other means reasonably capable of conveying your consent. We will obtain your express consent if we collect, use or disclose sensitive data. We also disclose information to third parties partners for whom you have given us consent.  Your consent may also be intrinsic to the circumstances such as in the case where you have already provided personal information to us and you maintain your relationship with us or where you provide our representatives with your phone number so that we can contact you. Except when otherwise permitted by law, we will only use the information for the purpose for which it was given. From time to time, we collect, utilize, or disclose your personal information based on your consent and as otherwise permitted by law.

When your consent is required, you can withdraw consent at any time (unless withdrawing the consent would frustrate the performance of legal obligations) upon providing us with a 30-day notice by sending an e-mail to [email protected]. However, the withdrawal of your consent may adversely affect our ability to provide products and services to you or to maintain our relationship with you.

Third Parties and Transfers of Data

We remain responsible for all personal information communicated to third parties for processing. As such, we ensure that third parties that are engaged to provide products or services on our behalf and are provided with personal information are required to observe the intent of this Privacy Policy by having comparable levels of security protection or, when required, by assuring us that they will not use or disclose the personal information for any purpose other than the purpose for which the personal information was disclosed.  

We are based out of the United States and thus must transfer your personal information across borders. We have taken appropriate safeguards to ensure your personal information is protected in accordance with this Privacy Policy through implementing additional safeguards, such as the standard contractual clauses.

Limitations

We only collect the personal information necessary to fulfill the purposes identified to you prior to or at the time of collection, or any other reasonable and legitimate purposes or as required by law.

We do not use or disclose your personal information, except for the purposes for which it was collected, or new purposes to which you have consented, or as required or otherwise permitted by applicable law.

We do not, as a condition of providing services to you or on your behalf, or as an administrative or management requirement, require consent to the collection, use or disclosure of personal information beyond that reasonably required for such purposes, or to comply with our obligations under applicable law.

Retention of Personal Information

We keep a record of your personal information, including correspondence or comments. We will utilize, disclose, or retain your personal information for as long as necessary to fulfill the purposes for which it was collected and for legal or business requirements. Opt-Out & Unsubscribe

We respect your privacy and give you an opportunity to opt-out of receiving communications from JBT by contacting us at [email protected]. You may also follow the instructions in any promotional message you get from us. If you opt out of getting marketing messages, you will continue to receive messages from us about your relationship with us where permitted by law.

Accuracy

We will use reasonable efforts to ensure that your personal information is kept accurate and complete. We will not routinely update your personal information, unless such a process is necessary or you request us to do so. Costs

We expect to provide access without charge as a general matter. However, we reserve the right to collect a reasonable charge when your request for the transcription, reproduction, or transmission of such information  is unfounded or excessive. We will notify you, following your request of the appropriate amount that will be charged. You will then have the opportunity to withdraw your request prior to incurring the charge. 

Identifying You in Connection with Requests

We may require you to provide us with sufficient information to identify yourself before we provide information about the existence, use, or disclosure of your personal information in our possession. Any such information shall be used only for this purpose.

Safeguards

We use physical, technical, and procedural security safeguards appropriate to the sensitivity of personal information to protect it from loss or theft, as well as unauthorized access, disclosure, copying, use or modification.
